1. Who Can Enter: Any legal U.S. resident 18 years of age or older is
eligible to participate in “SURFING MAGAZINE GOOGLE EARTH” Challenge
Sponsored by Nike 6.0 and Surfing Magazine (the “Challenge”). Employees,
officers, principals, directors or agents of Nike or Surfing Magazine
or their subsidiaries or affiliates (collectively, the “Contest
Sponsors”), and members of their households or immediate families,
are not eligible to participate.
2. How to Enter: Each entrant must register and complete an entry
form online at SurfingMagazine.com. The entry form must be submitted
between 12:01:00 am on July 20, 2007 pacific time (“Contest Open
Time”) and 11:59:00 pm on September 1, 2007 pacific time (“Contest
Close Time”). Any entry forms that are illegible, incomplete
or late will be disqualified.
3. Sweepstakes Dates: The Challenge will begin at the Contest Open Time
and end exactly at the Contest Close Time. The prize drawing will
be held based on number of eligible entries properly submitted, completed
and received between the Contest Open Time and the Contest Close Time.
4. Prizes: One (1) Grand Prize, five (1) Second Prizes will be chosen
based on a variety of factors including but not limited to – accessibility
of the submitted destination, quality and likelihood of quality surf,
timing, and weather factors. The Grand Prize winner will receive
(i) economy round trip air transportation for the winner from the closest
major airport to winner’s home to the selected destination. The
Grand Prize winners will be solely responsible for his/her own transportation
to and from winner’s home airport and any expenses and meals. The
winner and guest will each be required to sign a publicity and liability
release, and any other documents reasonably requested by the Contest
Sponsor, prior to receiving the prize. The Grand Prize has an approximate
retail value of $3,000.00.
The Second Prize winners will receive a one-year subscription to Surfing
Magazine. All prizes are “AS IS” without any warranty
of any kind, express or implied. No substitution, exchange or transfer
of prizes will be made or is permitted.
5. Winner Selection: The winners will be selected by the editors of
Surfing Magazine based on factors including but not limited to – accessibility
of the submitted destination, quality and likelihood of quality surf,
timing, and weather factors. Entries must be properly submitted between
the Contest Open Time and the Contest Close Time. The selection will
be held at the Surfing Magazine’s offices located at 950 Calle
Amanecer, Suite C, San Clemente, CA 92673 on September 5, 2007. The
winners’ names will be posted on www.surfingmagazine.com.
6. Odds of Winning: Each entrant's odds of winning are dependent on
the aggregate number of eligible entries properly submitted between the
Contest Open Time and the Contest Close Time. No purchase of any
kind is necessary in order to enter the Challenge or win any prize, and
chances of winning are not enhanced by making any purchases.
7. Winner Notification: The winners will be notified via telephone within
48 hours of awarding of the prize (which is currently anticipated to
occur on or around September 7, 2007). The winners will be required
to respond to any phone message to acknowledge receipt of Contest Sponsor’s
notification and awarding of prizes. If no response is received by Contest
Sponsor from winners within three (3) calendar days following the prize
notification message, the prize will be awarded to a replacement winner
to be determined by the Contest Sponsor in the Contest Sponsor’s
sole and absolute discretion. The winners will be required to prove eligibility
to receive and claim any prize. All decisions of the Contest Sponsor
about the winner are final, binding and non-appealable. Contest
Sponsor is not responsible for any incorrect or illegible address information
or the non-delivery of any prize resulting therefrom, or for any unsuccessful
efforts to notify a winner. It is the sole responsibility of the
entrant to notify the Contest Sponsor in writing or by e-mail if the
entrant changes his/her telephone number. (To do so, write to: Surfing

CA, 92673). In the event of a dispute regarding who submitted an
online entry, the entry will be deemed submitted by the authorized account
holder of the e-mail account.
8. Limits of Liability: Entrant acknowledges and agrees that the Contest
Sponsor(s) have no responsibility whatsoever for injuries, losses, or
damages of any kind that result from entrance into the Challenge or receipt,
acceptance, possession, or use of any prize. Contest Sponsor(s)
assume no liability for lost or misdirected entry forms regardless of
the circumstances. Contest Sponsor(s) maintain no control over the personnel,
equipment, or operation of any air, water or surface carrier, ship line,
bus or limousine company, transportation company, hotel, restaurant,
or other person or entity furnishing service, products, or accommodations
as a part of the prize package (the “Other Suppliers”). Contest
Sponsor(s) shall not be liable for any injury, damage, loss, expense,
accident, delay, inconvenience, or other irregularity that may be caused
or contributed to (1) by wrongful, negligent, or unauthorized act or
omission on the part of any of those Other Suppliers or any of their
agents, servants, employees, or independent contractors, (2) by any defect
in or failure of any vehicle, equipment, instrumentality, service, product,
or accommodation that is owned, operated, furnished, or otherwise used
by any of the Other Suppliers, (3) by the wrongful, negligent, or unauthorized
act or omission on the part of any other person or entity not an employee
of the Contest Sponsor(s) or (4) by any cause, condition, or event whatsoever
beyond the control of Contest Sponsor(s).
Contest Sponsor(s) reserve the right to cancel the Challenge at any
time if the integrity of the Challenge is, in Contest Sponsor’s
sole and absolute discretion, compromised in any way. By
entering the Challenge, entrants release and hold Contest Sponsor(s)
harmless from and against any and all damages and claims of any kind
in connection with the Challenge or resulting from entrance in the Challenge,
or receipt, acceptance, possession or use of any prize. Contest
Sponsor(s) reserve the right to substitute a prize for an alternative
prize of equal or greater value in Contest Sponsor’s sole and absolute
discretion.
All entries become the sole property of Contest Sponsor(s), and Contest
Sponsor(s) assume no responsibility for any (i) lost, stolen, delayed,
damaged or misdirected entries or for any failure of the website during
the Challenge period, or (ii) any problems or technical malfunctions
of any telephone network or lines, computer on-line systems, servers,
access providers, computer equipment, software, failure or delay of any
e-mail or entry to be received by Contest Sponsor(s) on account of technical
problems or traffic congestion on the Internet or at any website, or
(iii) any combination thereof including, but not limited to, any injury
or damage to an entrant’s or any other person’s computer
or other equipment related to or resulting from entrant’s participation
in the Challenge. Contest Sponsor(s) reserve the right, in their sole
discretion, to cancel or suspend the Challenge should a virus, bug or
other cause beyond the reasonable control of the Contest Sponsor(s) corrupt
the security or proper administration of the Challenge. Any attempt
to deliberately damage any website or to undermine the legitimate operation
of this Challenge is a violation of criminal and civil laws, and should
such an attempt be made, Contest Sponsor(s) reserve the right to seek
remedies and damages to the fullest extent permitted by law, including
criminal prosecution.
9. Winner Responsibilities: Each winner is solely responsible
for the reporting and payment of any tax liabilities incurred as a result
of or relating to the awarding or use of any prize. Entry into
the Challenge shall be deemed to be entrant’s consent and authorization
to (i) the use of entrant’s name, address (city and state only)
and any other information submitted by entrant for commercial, advertising
and promotional purposes in perpetuity without further compensation,
unless prohibited by law, and (ii) the use of entrant’s address
to receive marketing and other emails from Surfing Magazine and its affiliates.
In addition, by entering the Challenge, entrants affirm that they have
read, understood and accepted these Official Rules.
10. Winner Publicity: The Contest Sponsor will publish the first
name, last name and location (city/state) of each winner on the website
located at www.SurfingMagazine.com. To obtain the winners’ names,
send a self-addressed, stamped envelope to:

12. General: This Challenge is subject to all applicable federal
and state laws and regulations. By entering the Challenge participants
agree to be bound by these Official Rules and by the decision of the
Contest Sponsor(s), which shall be final on all matters relating to this
Challenge. This Challenge shall be void where prohibited by law.
13. Privacy: Contest Sponsor(s) may use any of the entrant’s
personal information submitted in connection with this Challenge.
